Tort Reform Myths
The popular term “Tort Reform” has been used in the media to describe laws designed to eliminate so-called frivilous lawsuits. The truth of the matter is that Tort Reform is a movement sponsored by powerful corporate and insurance interests to eliminate the consumer’s right to be compensated for losses due to such corporations negligence. Tort Reform is anti-consumer and designed to eliminate the individuals right to just compensation and access to the court house. Under the banner of “frivilous lawsuits” these anti-consumer spin doctors continually try to eliminate non-frivilous lawsuits by using ficticious cases and facts or miscategorizing the real truth about such cases.
The most abused case tort reformers hype involves a suit by a 79 year old womon who received serious burns from overheated McDonald’s coffee. The real facts about Stella Liebeck are much different from those facts which the public was led to believe.
As a public service, Davis, Saperstein & Salomon, P.C. will post the truth about tort reform on this website. You are invited to visit this issue below.
