Like other professionals, lawyers sometimes make mistakes in the handling of a client’s legal matter, which may adversely affect the final outcome of the legal matter. A judgment call by an attorney that did not have the desired outcome may not necessarily be negligent conduct giving rise to a legal malpractice claim. In all litigated matters there is always a winner and always a loser, and a loss of a case in and of itself does not necessarily give rise to a legal malpractice claim.
However, if the final adverse outcome is as a result of a lawye’rs negligence, incompetence, or omission, such lawyer or firm may be responsible for the damages suffered by the client. Most reputable law firms maintain legal malpractice insurance for such events.
